PREBOOK HOMES TERMS AND CONDITIONS (Customers)

INTRODUCTION

Welcome to Prebook Homes! These Terms and Conditions (“Terms”) govern your access to and use of the Prebook Homes website, mobile applications, and services (collectively, the “Platform”).

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform. Please read these Terms carefully before proceeding.

1. DEFINITIONS

In these Terms, the following definitions apply:

  • “Prebook Homes,” “we,” “our,” or “us” refers to Prebook Homes Ltd, a company registered in England and Wales.
  • “Platform” refers to the Prebook Homes website, mobile applications, and services.
  • “User,” “you,” or “your” refers to any person who accesses or uses the Platform.
  • “Landlord” refers to a User who lists property on the Platform.
  • “Tenant” refers to a User who books or rents property through the Platform.
  • “Subscription Plan” refers to the various service tiers offered to Landlords (Free, Starter, Growth, Professional, or Agency).
  • “Ren2Credit” refers to our service that reports rent payments to credit reference agencies.
  • “Listing” refers to a property advertised on the Platform.

2. USER ACCOUNTS AND REGISTRATION

2.1 Account Creation

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

2.3 Account Types

We offer different account types for Landlords and Tenants. Landlords may choose from various Subscription Plans, each offering different features and pricing as described on our Platform.

3. PLATFORM RULES AND POLICIES

3.1 General Rules

You agree to:

  • Comply with all applicable laws and regulations
  • Provide accurate information in all interactions on the Platform
  • Use the Platform only for its intended purposes
  • Respect the rights and dignity of other Users

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Harass, abuse, or harm another person
  • Impersonate any person or entity
  • Interfere with or disrupt the Platform or servers
  • Attempt to gain unauthorized access to any part of the Platform
  • Use the Platform to transmit harmful code or content

3.2 Rules for Landlords

Landlords must:

  • Provide accurate and complete information about their properties
  • Hold all necessary rights, licenses, and permissions to list their properties
  • Maintain and update property information to ensure accuracy
  • Honor all bookings and reservations made through the Platform
  • Comply with all applicable housing laws and regulations
  • Verify tenant identification before approving Ren2Credit reporting

3.3 Rules for Tenants

Tenants must:

  • Use valid and authorized payment methods
  • Provide accurate information when making bookings
  • Respect the terms of their tenancy agreements
  • Confirm occupancy through the “I have moved in” feature to release payments to Landlords
  • Report any issues promptly through appropriate Platform channels

4. PAYMENTS, FEES, AND REFUNDS

4.1 Payment Processing

All payments made through the Platform are processed by our authorized payment service providers. By making a payment, you authorize us to charge the designated payment method.

4.2 Fees and Commissions

  • For property sales: 2.5% commission from Landlords and 1.5% from Tenants
  • For rentals: 1.5% commission from Landlords and 2.5% from Tenants
  • Subscription fees as per the selected Subscription Plan
  • Additional fees for premium services as detailed on the Platform

All fees are non-refundable unless otherwise specified.

4.3 Tenant Payments and Security

When a Tenant makes a payment:

  • Funds are held securely until the Tenant confirms they have moved into the property using the “I have moved in” feature
  • Once confirmed, payment is released to the Landlord
  • If a dispute arises, funds may be held pending resolution

4.4 Cancellation and Refunds

4.4.1 Tenant Cancellations

Tenants may cancel a booking:

  • Before accepting a reservation request: Full refund
  • Up to 7 days before move-in date: Full refund minus processing fees
  • Less than 7 days before move-in date: Refund at Landlord’s discretion

4.4.2 Landlord Cancellations

Landlords may cancel a confirmed booking only in exceptional circumstances. Repeated cancellations may result in penalties or account suspension.

4.4.3 Monthly Subscription Bookings

For 30-day rolling subscription bookings:

  • Tenants must provide notice as specified in their tenancy agreement
  • The next 30-day period is automatically blocked from receiving additional bookings

5. REN2CREDIT FEATURE

5.1 Service Description

Ren2Credit is our proprietary feature that reports rent payment information to credit reference agencies to help Tenants build their credit history.

5.2 Consent and Opt-In

Tenants must explicitly consent to enroll in the Ren2Credit program. This consent can be provided during account registration, booking process, or through account settings.

5.3 Landlord Verification

Landlords must verify Tenant identification before approving participation in the Ren2Credit program.

5.4 Reporting Process

  • Rent payments are reported to credit reference agencies on a monthly basis
  • Late or missed payments may be reported and could negatively impact credit scores
  • Tenants can view their reporting status in their account dashboard

5.5 Withdrawal of Consent

Tenants may withdraw consent for Ren2Credit reporting at any time through their account settings. However, please note that Ren2Credit reporting is an integral part of our payment processing system. If you withdraw consent for credit reporting, you will no longer be able to process rental payments through our platform and will need to arrange alternative payment methods with your landlord. Withdrawal of consent will stop future reporting but will not affect information already reported.

6. CONTENT AND INTELLECTUAL PROPERTY

6.1 Platform Content

The text, graphics, images, software, and other content on the Platform (collectively, “Content”) are owned by or licensed to Prebook Homes and are protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

By submitting, posting, or displaying content on the Platform (“User Content”), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content.

6.3 Property Images and Descriptions

You represent and warrant that you have all necessary rights to post any images or descriptions of properties. We reserve the right to remove any content that violates these Terms or appears to infringe on the rights of others.

6.4 Reviews and Feedback

Users may leave reviews and provide feedback. All reviews must be honest, accurate, and comply with our review guidelines. We reserve the right to remove reviews that violate these guidelines.

7. LIMITATION OF LIABILITY

7.1 Platform Availability

We strive to ensure the Platform is available at all times, but we do not guarantee uninterrupted access. We are not liable for any downtime or service interruptions.

7.2 Property Transactions

Prebook Homes is a platform that facilitates connections between Landlords and Tenants. We are not a party to any rental agreement or transaction between Users. While we implement measures to promote trust and safety, we cannot guarantee the condition, quality, or safety of properties, or the accuracy of property listings.

7.3 Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.4 Limitation of Liability

To the maximum extent permitted by law, Prebook Homes, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from or relating to these Terms or your use of the Platform.

Our total liability for any claim arising from or relating to these Terms or your use of the Platform shall not exceed the amount paid by you to Prebook Homes during the 12 months preceding the claim.

8. DISPUTE RESOLUTION

8.1 Informal Resolution

If a dispute arises between Users, we encourage you to first attempt to resolve it directly. Our customer support team is available to assist with mediation if necessary.

8.2 Disputes with Prebook Homes

If you have a dispute with Prebook Homes, please contact us first and try to resolve the dispute informally.

8.3 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of England and Wales, and you consent to the jurisdiction of such courts.

9. TERM AND TERMINATION

9.1 Term

These Terms shall remain in full force and effect while you use the Platform or maintain an account.

9.2 Termination by You

You may terminate your account at any time by following the instructions on the Platform. Termination of your account does not relieve you of any obligations incurred prior to termination.

9.3 Termination by Prebook Homes

We reserve the right to suspend or terminate your access to the Platform and your account, with or without notice, for any reason, including if we believe you have violated these Terms.

9.4 Effects of Termination

Upon termination:

  • Your access to the Platform will be revoked
  • Pending transactions may be completed or cancelled at our discretion
  • Funds in your account may be held for up to 90 days to resolve any disputes or claims
  • Sections of these Terms that by their nature should survive termination shall survive termination

10. CHANGES TO TERMS

We may modify these Terms at any time. If we make material changes, we will provide notice through the Platform or by other means. Your continued use of the Platform after such notice constitutes your acceptance of the modified Terms.

11. MISCELLANEOUS

11.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Prebook Homes regarding your use of the Platform.

11.2 No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

11.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without your consent.
