INTRODUCTION
Welcome to Prebook Homes! These Terms and Conditions for Property Listers (“Lister Terms”) govern your access to and use of the Prebook Homes platform as a property lister. These Lister Terms supplement our general Terms and Conditions.
By listing property on our platform, you agree to be bound by these Lister Terms. If you do not agree, you may not list property on our platform. Please read these Lister Terms carefully before proceeding.
1. DEFINITIONS
In these Lister Terms, the following definitions apply:
- “Prebook Homes,” “we,” “our,” or “us” refers to Prebook Homes Ltd, a company registered in England and Wales.
- “Platform” refers to the Prebook Homes website, mobile applications, and services.
- “Property Lister,” “Landlord,” “you,” or “your” refers to any person who lists property on the Platform.
- “Tenant” refers to a User who books or rents property through the Platform.
- “Listing” refers to a property advertised on the Platform.
- “Subscription Plan” refers to the service tiers offered to Property Listers (Free, Starter, Growth, Professional, or Agency).
- “Commission” refers to the percentage of transaction value charged by Prebook Homes for successful bookings or sales.
2. PROPERTY LISTER ACCOUNT
2.1 Account Creation and Verification
To list property on the Platform, you must:
- Create a Property Lister account
- Provide accurate personal and property information
- Verify your identity and property ownership when required
- Accept these Lister Terms and our Privacy Policy
2.2 Subscription Plans
We offer the following Subscription Plans for Property Listers:
- Free Tier: Limited to 1 property listing with basic features
- Starter Tier (£5/month): 5 property listings with standard features
- Growth Tier (£15/month): 20 property listings with enhanced features
- Professional Tier (£35/month): 100 property listings with premium features
- Enterprise Tier (£80/month): Unlimited property listings with all features
Features and limitations of each Subscription Plan are detailed on our Platform and may be updated from time to time.
2.3 Account Management
You are responsible for:
- Maintaining accurate account information
- Keeping your account credentials secure
- All activities that occur under your account
- Notifying us of any unauthorized access to your account
3. PROPERTY LISTING RULES AND RESPONSIBILITIES
3.1 Listing Requirements
All property listings must:
- Contain accurate and complete information
- Include only images and content you have legal rights to use
- Comply with all applicable housing laws and regulations
- Meet our quality standards for descriptions and images
- Be available for the dates indicated as available
- Be priced according to the rates specified in your listing
3.2 Prohibited Content
Property listings must not:
- Contain false, misleading, or deceptive information
- Include discriminatory statements or requirements
- Violate third-party intellectual property rights
- Promote illegal activities or violate local laws
- Include direct contact information to circumvent our Platform
3.3 Listing Management
You are responsible for:
- Keeping your calendar and availability up to date
- Responding to booking requests within 48 hours
- Maintaining accurate pricing information
- Updating property descriptions and amenities as needed
- Managing and responding to reviews and feedback
4. BOOKINGS AND TRANSACTIONS
4.1 Booking Process
When a Tenant requests to book your property:
- You will receive a notification to approve or decline
- You must respond within the specified timeframe (typically 48 hours)
- Once approved, a binding agreement is formed between you and the Tenant
- You must honor all confirmed bookings
4.2 Fees and Commissions
- For property sales: 2.5% commission from Property Listers, 1.5% from Tenants
- For rentals: 1.5% commission from Property Listers, 2.5% from Tenants
- Subscription fees according to your selected Subscription Plan
- Additional fees for premium features as detailed on the Platform
All fees and commissions are non-refundable unless otherwise specified.
4.3 Payment Processing
- Tenant payments are processed through our secure payment system
- Funds are held until the Tenant confirms they have moved in
- Payments are released to you within 3 business days after the Tenant confirms occupancy
- If a dispute arises, funds may be temporarily held pending resolution
4.4 Cancellations
4.4.1 Tenant Cancellations
When a Tenant cancels a booking, our standard cancellation policy applies:
- Cancellations more than 7 days before move-in: Full refund to Tenant
- Cancellations less than 7 days before move-in: Refund at your discretion
4.4.2 Property Lister Cancellations
You may only cancel confirmed bookings in exceptional circumstances. Repeated cancellations may result in:
- Penalties or additional fees
- Negative impact on your listing ranking
- Suspension or termination of your account
5. REN2CREDIT FEATURE
5.1 Landlord Responsibilities
As a Property Lister, you have specific responsibilities regarding the Ren2Credit feature:
- Verify the identity of Tenants participating in Ren2Credit
- Approve or decline Tenant participation in the program
- Report accurate payment information
- Keep tenant payment records confidential
- Comply with all applicable data protection laws
5.2 Verification Process
Before approving a Tenant for Ren2Credit:
- You must verify the Tenant’s identity using government-issued ID
- Confirm the Tenant is the individual who will be occupying the property
- Use the “Tenant ID Approved” checkbox in your dashboard
- Complete this verification promptly to avoid delays in reporting
If a Tenant withdraws consent for Ren2Credit reporting, they will no longer be able to process payments through our platform. Property Listers should be prepared to establish alternative payment arrangements with any Tenants who choose to withdraw from Ren2Credit reporting.
5.3 Legal Compliance
You acknowledge that the Ren2Credit feature involves the processing of sensitive personal data and agree to:
- Only use this information for the intended purpose
- Maintain confidentiality of all Tenant information
- Report any data breaches or security incidents immediately
- Comply with all instructions regarding data handling
6. PROPERTY MANAGEMENT
6.1 Property Standards
You are responsible for ensuring that all properties listed:
- Are legally available for rent or sale
- Comply with all health and safety regulations
- Meet the standards described in your listing
- Are properly maintained throughout the tenancy
- Have all necessary permits and certifications
6.2 Tenant Relations
When interacting with Tenants, you agree to:
- Communicate professionally and respond promptly
- Respect Tenant privacy and confidentiality
- Address maintenance issues in a timely manner
- Follow proper procedures for entering the property
- Comply with all landlord-tenant laws
6.3 Monthly Bookings
For 30-day rolling subscription bookings:
- The next 30-day period is automatically blocked from receiving new bookings
- You must comply with notice periods as specified in the tenancy agreement
- You must clearly communicate any changes in terms for renewal
7. INTELLECTUAL PROPERTY
7.1 Your Content
By uploading images, descriptions, or other content to the Platform:
- You confirm you have all necessary rights to use and share this content
- You grant us a worldwide, non-exclusive license to use this content on our Platform
- You are responsible for any third-party claims related to this content
7.2 Removal Requests
If you receive a request to remove content that infringes on third-party rights:
- You must promptly remove the content from your listings
- You must notify us of the infringement claim
- You must cooperate with any investigation
8. ACCOUNT SUSPENSION AND TERMINATION
8.1 Suspension
We may suspend your account if:
- You violate these Lister Terms or our general Terms and Conditions
- We receive multiple complaints from Tenants
- You fail to respond to booking requests or communications
- We detect suspicious or fraudulent activity
- You fail to verify your identity or property ownership when requested
8.2 Termination
We may terminate your account if:
- You repeatedly violate these Lister Terms
- You engage in fraudulent or illegal activities
- You fail to remedy the cause of a suspension
- You have no active listings for an extended period
- You request account termination
8.3 Effects of Suspension or Termination
Upon suspension or termination:
- Your listings may be removed from the Platform
- Pending bookings may be cancelled
- Funds in your account may be held for up to 90 days to resolve disputes
- You may lose access to your account and listing history
9. LIMITATION OF LIABILITY
9.1 Platform Services
We strive to provide a reliable platform but cannot guarantee:
- Continuous, uninterrupted access to the Platform
- A specific number of booking requests or views
- The behavior or reliability of Tenants
- The accuracy of third-party information
9.2 Property Transactions
Prebook Homes is a platform that facilitates connections between Property Listers and Tenants. We are not:
- A party to any rental or sale agreement
- Responsible for Tenant behavior or property damage
- Liable for financial losses due to cancellations or disputes
- Responsible for verifying all information provided by Tenants
9.3 Limitation of Liability
To the maximum extent permitted by law, we limit our liability for:
- Any indirect, incidental, or consequential damages
- Loss of profits or business opportunities
- Any amount exceeding the fees paid by you during the 12 months prior to the claim
- Damages arising from your violation of these Terms
10. DISPUTE RESOLUTION
10.1 Disputes with Tenants
If a dispute arises with a Tenant:
- Attempt to resolve the issue directly with the Tenant first
- Use our messaging system to keep a record of communications
- Contact our support team if you cannot reach a resolution
- Provide all relevant documentation to support your position
10.2 Disputes with Prebook Homes
If you have a dispute with Prebook Homes:
- Contact our support team to explain the issue
- Provide all relevant information and documentation
- Allow reasonable time for investigation and response
- Follow our escalation process if necessary
10.3 Governing Law
These Lister Terms shall be governed by and construed in accordance with the laws of England and Wales. Any legal proceedings shall be brought exclusively in the courts of England and Wales.
11. CHANGES TO LISTER TERMS
We may modify these Lister Terms at any time. If we make material changes:
- We will provide notice through the Platform or by email
- The changes will take effect after the notice period
- Your continued use of the Platform constitutes acceptance of the modified terms
